If You Previously Received a Notice Stating You Were Impacted by the Ransomware Attack Perpetrated on Penhall Company, You Are Eligible to Receive Payments from a Class Action Settlement

● If you have received a notice, you are eligible to receive benefits from a proposed class action settlement. To be eligible to make a Settlement Claim, you must be a Person in the United States and must have previously been mailed a notification from Penhall Company ("Penhall") that your information may have been impacted in the Ransomware Attack discovered on December 28, 2022.


● The Litigation alleges that on or about December 28, 2022, Penhall was the target of a criminal cyberattack in which third-party criminals gained unauthorized access to Penhall’s network and attempted to encrypt Penhall’s data (“Ransomware Attack”).  Plaintiffs further claim that, as a result of the Ransomware Attack, the criminals gained access to Plaintiffs’ and the Settlement Class Members’ personally identifiable information, including, but not limited to, names, driver’s licenses, dates of birth, and Social Security Numbers (collectively, “PII”).


● Defendants deny any wrongdoing and deny that they have any liability but have agreed to settle the Litigation on a class-wide basis.

 

Under the Settlement Agreement, Settlement Class Members will be eligible to receive:

  • Reimbursement for any documented out-of-pocket expenses, not to exceed $500 per Settlement Class Member; lost time spent dealing with the Ransomware Attack up to three (3) hours at $25 per hour; and extraordinary losses of proven monetary loss for up to $10,000 per Settlement Class Member as a result of the Ransomware Attack

        AND

  • Credit Monitoring – In addition to the reimbursements above, each Class Member who submits a Valid Claim may elect to receive 12 months of credit monitoring.

Do NothingReceive no payment from the settlement. Give up any right to bring any other Litigation against the Released Persons for the same claims.
